The Board members of Save Our Village have devoted a year of their lives to researching the third track issue that will dramatically change New Hyde Park forever. Following countless hours researching this extremely complex issue, we then enlightened those who were interested as to the results of this diligent research. We persevered in our attempts to educate the public at large about the widespread consequences should this project come to fruition. At this point in time, our efforts have reached the pinnacle of what a group of civic-minded individuals could ever hope to accomplish under such difficult circumstances.

On February 19th, 2008, we met with Helena Williams, President of the LIRR. At this meeting, our concerns, hopes and fears were given a voice, and we realized that our time in this quest as a small civic group had reached the saturation point. Having then informed the NHP Mayor Dan Petruccio of the issues and possible solutions which we have discussed, we placed the fate of our village regarding the third track issue squarely and finally with the Village Board.

As President of Save Our Village, I would like to thank everyone who joined with us throughout our difficult journey. Board members, Diane Bentivegna, Roseann Farina, and Cristina Prieto-Maroney have dedicated countless hours and expended great energy over the past twelve months in order for us to accomplish our mission. I am very proud to have worked with these people, and I consider them very dear friends. The decisions now rest in the hands of the LIRR and the public officials who represent the individual towns and villages. We wish the Mayor and Trustees of the Village of New Hyde Park the courage and fortitude to meet the difficult challenges ahead, keeping the best interests of the citizens of New Hyde Park first and foremost.

Save Our Village: A Year In Review

As Save Our Village continues to address the issues raised by the MTA's Mainline Corridor - Third Track Project, it has come increasingly evident that our supporters cherish our Long Island community and they support those who seek to preserve its suburban quality of life. In addition to presenting our community with an educational seminar, "Citizens vs. the Threat of Eminent Domain," Save Our Village listens to the concerns of our supporters and disseminates well-documented research by mail and by posts on this blogspot. We also continue to examine all the evidence, compile documented research, and work with experts in the fields of engineering and environmental science to prepare for the upcoming DEIS public hearings. Additionally, Save Our Village continues to explore alternatives to the MTA/LIRR's proposals so that we are prepared to offer viable solutions to the problems inherent in the current plans. We are grateful for the genuine support of all our supporters as well as the support of neighboring community alliances which have joined us in our mission. With respect to community advocacy, it has been our belief that the issues raised by the MTA's proposals trump all political affiliation and all other philosophical differences that may keep us apart since the future stability of our community and lives of several families and small businesses are literally on the line! With this in mind, we have remained apolitical in our outreach and have made an appeal to ALL local, state and federal government representatives - regardless of their political affiliation. In brief, some of these government leaders include: the New Hyde Park Village Board of Trustees, Councilman Angelo Ferraro, the NHP-GCP School Board, the NHP Fire Department, Town of Hempstead Supervisor Kate Murray, Town of North Hempstead Supervisor Jon Kaiman, Nassau County Executive Tom Suozzi, Nassau County Legislator Rich Nicolello, NY Assemblyman Tom Alfano, NY Assemblyman Tom McKevitt, NY State Senator Dean Skelos, NY State Senator Craig Johnson, and US Congresswoman Carolyn McCarthy. Although some responded to our appeal with varying degrees of commitment, and others have embraced our nonpartisan spirit more than others, we believe they all share our serious concern about the future challenges we face as a Long Island community.

Across the year-long journey we have traveled, Save Our Village has learned that this railway expansion project is one part of a much larger vision being planned for Long Island's future. The social changes and economic demands of the growing Long Island region have become formidable catalysts for change. We have reluctantly concluded that one such inevitable consequence of these catalysts is the fact that more trains will be traveling along the mainline - and through the Village of New Hyde Park - regardless of the third track! Moreover, substantial evidence is mounting which seemingly indicates that the MTA/LIRR's capital project is moving ahead:

First, President Bush's recommended budget for 2009 proposes $219 million for the long awaited LIRR East Side Access Project which would connect the LIRR to Grand Central Terminal. These plans all for the Mainline and the Port Washington line to run from Queens to the new LIRR terminal beneath Grand Central. There is also $277 million allotted for the completion of the Second Avenue Subway line. Both budget recommendations were received positively by NYS representatives.
Secondly, other federal and state transportation appropriations will be reviewed by the MTA Capital Program Review Board in the near future. These long awaited funds will bring the MTA's proposals closer to fruition.
Thirdly, railroads will see a big financial boost, under recommendations from a Congress-appointed commission to fund much-needed transportation infrastructure improvements. The National Surface Transportation Policy and Review Study Commission said in its report to Congress earlier this month, "the nation needs to invest between $225-$340 billion to upgrade the nation's surface transportation system to sustain strong economic growth."
Fourth, a NY State Panel recently recommended that NYC Mayor Bloomberg's Congestion Price Plan be adopted. It is our understanding that the funds raised by congestion pricing are being tied to one or more of the MTA/LIRR's proposed capital projects insofar as the revenue realized will be used to offset some of the costs of the Third Track Project.
Fifth, sections of the third track have already been prepared and/or installed along the mainline corridor: the Herricks Road elevated track already has a third track, a section of land beneath the Mineola Blvd. overpass has been reserved for the third track, the new Roslyn Road track line has a section reserved for the third track, and the third track has already been installed east of Nassau Blvd. - in Garden City, in Garden City Park, and in Mineola.
Sixth, plans for the LI Truck-Rail Intermodal Facility Project (LITRIM), a mega freight yard in Suffolk County, are well underway. This plan, along with the Third Track Project, is expected to increase the railroad's capacity for transporting more freight along the mainline corridor. This belief, in fact, has been confirmed by many business organizations such as the Long Island Association, the New York Metropolitan Transportation Council and the Long Island Mid Suffolk Business Action. The LIRR asserts, however, that the goal of the Third Track Project is to "improve service reliability for its customers."
Seventh, the NYC Economic Development Corporation confirmed in Oct. 2007 that the Cross Harbor Rail Freight Tunnel Project is moving ahead. Restarting this project is considered " a commitment to promoting rail as an alternative to trucking and to change the way we move freight in the NY area." The proposed tunnel would run from Jersey City, under NY Harbor to Brooklyn. The rail line would then continue through Bay Ridge, Borough Park, parts of Flatbush, and then on to Queens, where cargo would be transferred to trucks for delivery into the city or points north and east (which is Long Island). Again, the LIRR asserts that the goal of the Third Track Project is to improve service reliability to its customers. Those pushing the project believe "this project will be beneficial to New York as jobs are created when freight is diverted from truck to rail."
Lastly, legislation was recently introduced to the NY Assembly in February, 2008 which seeks to make certain that local municipalities are notified about the transport of hazardous materials on the rails. After many years of freight transportation along the mainline, this new rail safety legislation, which specifically targets freight traffic along the LIRR, implies some level of preparedness for the increased freight rail capacity which is inherent in the Third Track Project. Freight trains on Long Island are operated by NY and Atlantic Railways which leases the tracks owned by the LIRR.

In recognition of this evidence, along with countless hours of outreach to citizens, citizens' groups and government representatives, the issue of railroad expansion has brought Save Our Village to a vast divide! Some continue to proclaim their absolute opposition to the MTA's proposals. Others have voiced opposition to certain parts of these proposals (i.e.: opposition to the Third Track Project, but support for the crossing elimination projects). And, there are still others who believe that the overwhelming evidence indicates the inevitable nature of the situation and we are left with only one recourse - to vigorously negotiate with the LIRR until our demands are addressed and/or met. Regardless of category, Save Our Village asserts that it is just not enough to say we are opposed to the third track anymore! The time has come for action - CITIZENS' ACTION. Valuable time is passing and we need to work together to show that we are one voice for New Hyde Park - a nonpartisan voice which demands that the MTA/LIRR step up to the plate and acknowledge the concerns of countless citizens by genuinely exploring viable alternatives to their original proposals. Once again, Save Our Village favors the best plans which inflict the least collateral damage to homes, neighborhoods, small businesses, and the Long Island region.

Putting words into action, the officers of Save Our Village met with Mrs. Helena Williams, President of the LIRR and various representatives of the MTA/LIRR on Tuesday, Feb. 19, 2008. Our intention was threefold:

to represent the needs and best interests of our supporters,
to learn more about the details of the project directly from the source - the MTA/LIRR
to take a respectful first step toward building a working relationship with those who seek to make permanent changes to our community.

During this meeting, Save Our Village brought important issues to the attention of those in attendance - issues of vital interest to our supporters. Just as important, we listened carefully to the MTA/LIRR's proposals in detail. It is important to note that Senator Craig Johnson supported Save Our Village's effort to seek the facts, and he repeatedly expressed his vehement opposition to the MTA/LIRR's current proposals throughout the meeting.

Additionally, a proposal was made to explore the opportunity for Mrs. Williams and the MTA/LIRR staff to directly address the citizens of New Hyde Park at a community meeting. Save Our Village agreed to inform New Hyde Park Mayor D. Petruccio of this proposal so that he and the Village Board could best decide the direction to take for outreach to our entire community.

It is important to note that the New Hyde Park Village Board of Trustees represents the citizens of our village, many of whom are Save Our Village's active supporters. The Village Board has the people's mandate to represent its interests, and the Village Board has the binding authority to negotiate with the LIRR. To do their job effectively, however, the Board must hear from "we, the people." Although many of us remain overwhelmingly distressed by the diverse statements made by those on both sides of this issue, it is our civic responsibility to tell our representatives what we want! Thus, we have reached out to Mayor Petruccio to inform him of these and other developments, and we trust that he and the Village Board of Trustees will give consideration to our findings. We realize that these are challenging times, and Save Our Village's focus remains steadfast on our mission and our commitment to our supporters. We earnestly seek to work with all citizens, citizens' groups, and all elected representatives to address these issues in a nonpartisan manner and to vigorously represent the voice of our supporters - the hardworking homeowners and taxpayers of the Village of New Hyde Park in the critical months and years ahead...

Your Voice and Your Commitment Counts, Long Island!

According the the most recent news updates, the MTA may be compelled to eliminate more that $1 billion from its budget for three of its most important "mega-project" proposals. These projects include the Fulton Transit Center, the Long Island Railroad link to the Grand Central Terminal, and the Second Avenue Subway. Originally budgeted at $15 billion in public money, the estimated cost of these projects could now exceed more than $16 billion. The MTA's CEO, Mr. Elliot Sander said, "While I continue to be committed to providing the transportation benefits and the purpose of each and every one of these transportation projects, we will likely need to trim them back to the maximum amount possible." Mr. Sander, MTA Chairman Dale Hemmerdinger, and MTA Capital Construction Co. President Mysore Nagaraja have cited rising construction costs and increasing costs for steel and concrete as major factors which contribute to the MTA's budget shortfalls. "If cuts are to be made, the goal would be to maintain the 'best transportation function' of the projects," Sander said. It seems although the plans for the Second Avenue stations will remain as stated, the plan to install a third track in an uptown section (which will allow trains to bypass railway problems) will likely be cut.

Also important to note is the fact that the MTA-LIRR has recently submitted its Draft Environmental Impact Statement (DEIS) for its "third track project" to the Federal Transit Administration. [Citizens are encouraged to refer to the Dec. 7th post below to learn more about the capital project process.] This project, which is included in the comprehensive LIRR Mainline Corridor Improvement Project, has two proposed plans:

PLAN A proposes up to four grade crossing elimination projects and impacts 91 properties in New Hyde Park and Westbury.
PLAN B proposes two grade crossing elimination projects and impacts 82 properties in New Hyde Park and Westbury.

Presently, the LIRR refuses to release its proposals to the public and has referred all requests for information about the properties affected by the project to the Federal Transit Administration. Unfortunately, the FTA has yet to release copies of the LIRR's preliminary plans.

LIRR President Helena Williams recently admitted that the railroad's original premise for the project, the "reverse commute", was not true, and presently claims that the third track is need as "a passing lane" so that trains will not suffer from any "residual delay" heading to Grand Central Station through the East Side Access tunnel (which is expected to be completed in 2014).

Both Plans A and B specify the need to:

eliminate the New Hyde Park Road crossing by a long and complicated process which will reconstruct a roadway beneath the railroad tracks (tracks which will include the newly installed third track), redirect vehicular traffic through residential neighborhoods and claim whole or parts of private properties via eminent domain.
close Urban Avenue in Westbury to all vehicles where it intersects with the LIRR. All vehicles would be redirected across a bridge built from Bond Street, south of the tracks, to connect with Railroad Avenue, just to the northwest. A separate footbridge would be installed over the tracks at Urban Avenue.

Specifically in New Hyde Park:

PLAN A - which eliminates 91 properties in NHP and Westbury via eminent domain - also includes the elimination of the Covert Avenue crossing and reconstructing this roadway below the railroad tracks via a long and complicated process similar to the NHP Road crossing elimination; this process will result in serious environmental and economic impacts to families in the area and the general community. It also proposes to eliminate the South 12th Street crossing by closing it to all vehicular traffic, with a footbridge built over the tracks there. This plan can also potentially reduce the NHP Fire Dept.'s access to homes and businesses south of the railroad tracks.
PLAN B - which impacts 82 properties in New Hyde Park and Westbury via eminent domain - would leave Covert Avenue and South 12th Street open; quadrant gates are proposed at these crossings which actually increase gate down time and promote greater roadway congestion and environmental hazards.

COMMENTARY:

The MTA has finally admitted that its budgetary shortfalls and disaster-bound construction schedules place the future of its mega-projects in serious jeopardy. It has admitted that it has no funds left to build the Fulton Street Transit Center as it was originally promised to residents and business owners, as well. Since 2005, this project has caused massive chaos, closed subway entrances, dug up streets and sidewalks, and damaged neighboring stores and office buildings - with no end in sight! It has evicted viable stores, restaurants and businesses and tore down six buildings. Track work has disrupted subway service as far as Brooklyn! Clearly aware of its impending deficits, the MTA plotted to scale back its original grandiose proposals - and, sadly, this newly scaled back version seems to renege on many promises that it made to affected commuters, residents, and business owners. The MTA has finally admitted what $900 million (and counting) in public money for the Fulton Street Transit Center has bought the City of New York: a rodent-infested, vacant lot!

WAKE UP, LONG ISLAND...WAKE UP!!!

From our inception in March 2007, Save Our Village has always favored the crossing elimination projects in New Hyde Park. However, we are vehemently opposed to the aforementioned plans in the MTA's DEIS because they jeopardize our community's economic stability, environment, and suburban quality of life. We demand that the MTA-LIRR and all federal, state and local representatives hear our voice, explore viable alternatives and negotiate fairly with citizens in order to promote the best plan that inflicts the least collateral damage to residents and community.

How can the citizens who live, work, and travel through the communities affected by the proposed LIRR Mainline Corridor Improvement Project be assured that the budgetary shortfalls and disaster-bound construction schedules that plagued the Fulton Transit Center will NOT be repeated in our own Long Island communities? As Americans, we enjoy many rights and freedoms, but we also bear the responsibility to be active citizens so that our elected local, state and federal officials can appropriately represent our interests. New Hyde Park and all mainline communities will face serious challenges in the near future - challenges which potentially threaten our suburban quality of life , school and property taxes, and property values. These challenges demand our immediate attention. We must resolve to work together, along with our representatives, to protect and preserve our neighborhoods and entire Long Island region. We must make our concerns known to those who have direct influence on these matters and proactively work with our represenatives - they want to hear from us!

Not only does this jeopardize our economic stability, but it also will raise the funds which puts our suburban quality of life at serious risk. State Panel Recommends Version of Congestion Plan

A state panel yesterday recommended a scaled-down congestion pricing plan that would charge commuters $8 to enter Manhattan south of 60th Street during peak hours but would permit free movement within the zone.

The plan, which would also increase metered parking costs and impose a $1 surcharge on taxis, is expected to generate $520 million a year and save on administrative costs over another version of the plan that set a larger congestion zone, according to the commission's findings.

Two members of the 17-person traffic commission voted against the proposal following months of contentious debate and public hearings. It is the first step in what is shaping up to be a combative legislative process. To be enacted, the plan must be approved by the City Council and the State Legislature, which must act before a March 31 deadline or risk losing $354.5 million in federal funds for improving mass transit.

Assemb. Richard Brodsky (D-Westchester), a commission member, blasted the alternative plan yesterday as a "regressive tax on the middle class. The commission took a bad plan and made it worse," Brodsky said in an interview. "It reduces the burden for people who live in Manhattan and increases it for people outside." (pictured left)

Mayor Michael Bloomberg, who had championed a pricing plan that would have set the border of the congestion zone at 86th Street, said he accepted the alternative plan and urged both legislative bodies to act before the federal deadline. "The plan that the commission is recommending today meets our goals of reducing congestion, cutting carbon emissions and providing much-needed funds to improve mass transit for millions of New Yorkers," he said. "New York cannot afford to walk away from hundreds of millions of dollars in federal funds and a guaranteed revenue stream for the MTA's capital plan." (pictured right)

Other proposed plans included charging $8 round trip on East River and Harlem River bridges, and restricting access to parts of Manhattan based on license plate numbers.

More than 60 percent of city voters polled by Quinnipiac University last month said they supported congestion pricing if all the money it generated were earmarked toward mass transit improvements.

Reaction among legislative leaders in Albany mirrored last year's divide, with the State Senate's Republican majority expressing general support, while the Assembly's Democratic majority continuing to have reservations.

"I believe the commission's work is not done," said Assembly Speaker Sheldon Silver (D-Manhattan), who asked whether tax credits would be given to low-income motorists who pay congestion fees and urged that all tolls be dedicated to mass transit improvements. (pictured, left)

Senate Majority Leader Joseph Bruno (R-Brunswick), an early supporter of Bloomberg's plan, noted the commission held 14 public hearings to gather residents' input before issuing recommendations. Bruno said, "Mayor Bloomberg began this process when he unveiled a thoughtful and ambitious plan to improve the quality of life in and around New York City, and we look forward to working with him as this plan moves ahead in the review process." Bruno and his Republican conference rely on hefty campaign contributions from the mayor to help maintain a slim, two-seat majority in the Senate, the sole remaining GOP power base in the Capitol. Gov. Eliot Spitzer called for prompt action, saying, "the economic impetus behind congestion pricing is strong, as is the potential for cleaner air, improved public health, and a steady and predictable source of funding to support the MTA's capital plan ... The specifics of the plan will be discussed and debated, but the profound implications for our entire transit system are clear." (pictured left)

From the Desk of Senator Craig M. Johnson: Don't Tread On Us

The following testimony from Senator Craig M. Johnson was read into the record of a Jan. 24, 2008 meeting of the New York City Traffic Congestion Mitigation Commission at Hofstra University:

Thank you members of the Commission for hosting this meeting in Nassau County. As you know from previous testimony I have given, I am opposed to Mayor Bloomberg’s Congestion Pricing plan, as I believe it will place an undue burden on the residents of Long Island who commute into Manhattan.

I have already stated my reasons for this, however I have a new set of concerns that greatly reinforce my opposition. Today I speak from the heart. It is my understanding that Congestion Pricing is now being tied to one or more of the MTA / LIRR’s proposed capital projects insofar as revenue realized from the pricing plan will offset some of the costs of the Third Track, which affects many communities that I represent.

It simply comes down to this – you want to impose a commuter tax on Long Island residents and in-turn fund a project that has been so far justified by what seems to be a new explanation each week.

First it was to handle increased freight, then it was to handle a non-existent reverse commute, and now the current reasoning is that a passing lane is needed for increased ridership from east to west – an HOV lane of sorts for the railroad.

To follow the flip-flopping is maddening for anyone who may be affected by this. And yet -- this continues to press on, tying one poorly vetted idea to another as it relates to community impact. You will do nothing here but shift congestion from New York City to Nassau County. You will turn our neighborhoods into parking lots. And, you will choke the flow of traffic and destroy what remains of our suburban quality of life if you do not take local concerns into account.

If I may coin a new term, we are witnessing the birth of “dumb growth.” You are robbing Peter to pay Paul. The problem is, Paul will not be satisfied until Peter is not only broke, but buried under a mountain of traffic and train tracks.

I implore you to listen to the residents who care so much about their neighborhoods. Please listen to the local elected officials who know their communities and care about their future direction. Again, please take local concerns into consideration and the negative impact these plans can have before you move forward. Thank you.

Statement by Senator Craig M. Johnson on Proposed Legislation to Notify Localities of the Rail Transportation of Hazardous Materials

"This is common sense legislation that should be passed as soon as possible. While communities and first responders need to be prepared for anything that comes along our rails, the fact that this type of dangerous material can be transported through our neighborhoods at any time of the day or night should give anyone within the range of the train lines some serious pause. With several other rail expansion projects already in the planning stages, the potential to increase the capability to transport this and other types of freight through our communities is both very real and, in certain instances, very dangerous.

The MTA/ LIRR should address this situation, even before such legislation is made law, by providing iron-clad guarantees to residents that this unfettered access will be restricted; by mandating that freight companies start to notify them and affected localities now of the transport of any hazardous material; and by limiting such transports to times of day when first responders can best deal with the fallout of any accidents involving this material."

Since March 2007, we have been contacted by many distressed citizens in New Hyde Park, Floral Park, Mineola, Carle Place, Westbury and Garden City about the proposals set forth in the MTA’s “LIRR Mainline Corridor Improvement Project.” We believe that one of the major goals this project, coupled with the LI Truck-Rail Intermodal Facility Project in Suffolk County, is to increase the railroad’s capacity for transporting more freight along mainline corridor. This belief, in fact, has been confirmed by many business organizations such as the Long Island Association, the New York Metropolitan Transportation Council, and the Long Island Mid Suffolk Business Action. An increase in freight rail traffic, which includes the transport of all kinds of materials, including hazardous materials, results in permanent undesirable effects – effects which can potentially threaten the quality of life, safety and security of all citizens who live, and go to school, and work or just travel through our neighborhoods. As a matter of fact, on November 30th, Save Our Village posted an alert to residents about Brookhaven National Lab and its plan to transport radioactive soil along the mainline. We learned that this radioactive cargo must be disposed of at a special containment facility in Utah. Inherent in that message was the implication that there was some kind of health risk associated with this radioactive soil which prompted its removal from Brookhaven Lab.

According the United States Environmental Protection Agency, “Any activity that produces or uses radioactive materials generates radioactive waste. Various processes in industry, defense, medicine, and scientific research produce byproducts that include radioactive waste. Radioactive waste can be in gas, liquid or solid form, and its level of radioactivity can vary. The waste can remain radioactive for a few hours or several months or even hundreds of thousands of years. Because it can be so hazardous and can remain radioactive for so long, proper disposal is essential to protect the health and safety of the public and the quality of the environment including air, soil, and water supplies. Radioactive waste disposal practices have changed substantially over the last twenty years. Evolving environmental protection considerations have provided the impetus to improve disposal technologies. Designs for new disposal methods must meet environmental protection and pollution prevention standards which are much stricter than were foreseen at the beginning of the atomic age.” (picture on the left: Robert Femminella, President, SOV)

Needless to say, when we shared this documented research from the US EPA with our supporters, they were outraged, especially when they learned that their local government representatives were left uniformed of this serious operation, and thus, denied access to information regarding the appropriate disposal of this cargo – critical information that would be needed by first responders, if by chance there was an unfortunate accident on the rails. Not only did this place our policemen, firemen, and other emergency personnel at serious risk, but it also jeopardized their ability to protect so many residents who live along the mainline. As representatives of the collective voice of so many citizens who live in communities along the mainline, Save Our Village wishes to positively recognize Assemblyman Alfano's acknowledgment of our concerns by sponsoring this crucial legislation. Demanding that companies inform local municipalities about the transport of hazardous materials will ensure that the necessary and proper precautions are taken to protect our neighborhoods.

In response to a recent published interview with LIRR President Helena Williams in a local NHP newspaper, Save Our Village wishes to clarify a statement expressed by Ms. Helena Williams, President of the LIRR:

Save Our Village New Hyde Park Association was extended an invitation to attend a MTA-LIRR public relations presentation hosted by Mr. Jerry Kramer in May, 2007. This presentation was also attended by members of the NHP School Board, NHP Fire Department, Parks Civic Association, the LIRR Task Force for the Village of New Hyde Park, Deputy Mayor Lofaro, Trustee Montreuil and his wife, Village of NHP Superintendent of Public Works (Mr. J. McCloat) and others. At this gathering, representatives of the LIRR-MTA presented an MS Powerpoint presentation of the proposed LIRR Mainline Corridor Improvement Project and entertained questions from the audience on the project. During this gathering, there were no discussions and/or negotiations of any kind about the proposals presented that evening.
The platform of Save Our Village New Hyde Park Association, Inc. is exclusively represented by its officers: Mr. Robert Femminella (President), Diane Bentivegna (Vice President), Cristina Prieto-Maroney (Vice President).
To this date, the officers of Save Our Village New Hyde Park Association, Inc. have NEVER communicated with any MTA and/or LIRR representatives, including Ms. Helena Williams, in a face-to-face "meeting", telephone conversation and/or any other forum of communication - ever! Any statement by Ms. Williams and/or any representative of the MTA - LIRR that suggests otherwise should be considered a blatant disregard for the truth.

SAVE OUR VILLAGE NEW HYDE PARK ASSOCIATION, INC. has always encouraged honest collaboration and a spirit of compromise to facilitate peaceful resolutions to problems. Sadly, our supporters are dismally disappointed that the MTA-LIRR and Ms. Helena Williams has chosen the path of misrepresenting the facts to promote their own goals (and profits!) at the expense of hardworking homeowners and taxpayers. First, it was the "reverse commute", and then it became "the billion dollar passing lane". Finally, the MTA-LIRR still proclaims "the project is not about freight" despite the demand for increased freight rail capacity by such business organizations as the Long Island Association, the New York Metropolitan Transportation Council, and the Long Island Mid Suffolk Business Action which resulted in the establishment of a new mega-freight yard in Suffolk County (Long Island Truck Rail Intermodal Project aka LITRIM Project)! We strongly urge Ms. Williams to retract her misstatement (i.e. "...meetings with Save Our Village") and take all the necessary steps to correct the record in the NHP press for the sake of restoring "good faith" relationships with the communities impacted by the LIRR proposals.

To repeat again:

Save Our Village's has ALWAYS favored the at-grade crossing elimination projects in New Hyde Park. As a matter of fact, we invite interested citizens to read the archive of blog posts (below) so that you may note our statements in favor of the NHP at-grade crossing eliminations on June 11th, Nov. 19th, and Dec. 19, 2007. We do, however, oppose the CURRENT PROPOSALS for these projects at Covert Ave., South 12th Street, and New Hyde Park Road because we believe the present plans jeopardize our economic stability, environment, and suburban quality of life. Save Our Village insists that the MTA-LIRR and all federal, state and local elected representatives of the mainline communities must:

explore alternatives which promote safety, reduce roadway congestion, and preserve our suburban lifestyle;
promote the best plan that inflicts the least collateral damage to family homes and properties, regardless of its cost
negotiate respectfully with all citizens who are directly and indirectly impacted so that they do not suffer unfair economic hardship and can remain residents within their chosen community

In the United States, there are several agencies assigned to transportation. Following the events of 9/11, a new federal agency, the Transportation Security Administration (TSA), was authorized to ensure the security of highways, railroads, buses, mass transit systems and airports. Like other federal agencies, the TSA is subject to the laws passed by Congress. On March 8th, 2007, a bill called the Rail and Public Transportation Security Act of 2007 (HR 1401) was introduced in the House of Representatives. It is important to note that this bill was passed in the House of Representatives as of March 27, 2007 and is presently being reviewed in the Senate.

Save Our Village is pleased to report that, once again, Congresswoman Carolyn McCarthy advocated to increase railway security nationwide by voting for HR 1401. By doing so, she actively demonstrates her understanding of the serious issues which impact the quality of life for so many residents living in "mainline" communities within the 4th Congressional District. Her vote supports measures which will improve the safety of rail and public transportation infrastructure as well as the establishment of grants for the local agencies which will provide security for public transit, increase security for railroads and training for railroad, public transit and bus employees. HR 1401 states that these security-related grants will be based on risk which ensures that New York will receive its fair share of the federal funding. Save Our Village positively acknowledges Congresswoman McCarthy's continued dedication to the health, safety and security of her constituents in the 4th Congressional District.

In brief, the proposed Rail and Public Transportation Security Act (HR 1401) directs the Secretary of Homeland Security for the Department of Homeland Security to develop and implement a plan called the National Strategy for Rail and Public Transportation Security. It requires the Secretary to assign each railroad carrier, public transportation operator, or bus private operator to a certain risk-based tier and to issue regulations that: (1) require each transportation provider to a high or medium-risk tier to assess their vulnerability to terrorism and to implement a security plan that addresses certain security performance requirements; (2) establish standards for such assessments and plans; and (3) establish a security program for transportation providers not assigned to a high or medium-risk tier. It also imposes civil and criminal penalties for failure to comply with the requirements of this Act.

Specifically, the Rail and Public Transportation Security Act includes:

Section 124 - directs the Secretary to issue regulations that require certain enhanced security measures for shipments of security sensitive materials

Section 126 - directs the Secretary and the Secretary of Transportation to jointly assess likely methods of deliberate attacks against rail tank cars used to transport toxic-inhalation-hazard materials, including the degree to which these methods may be successful in causing death, injury, or serious adverse effects to human health, the environment, or public welfare;

Section 127 - directs the Domestic Nuclear Detection Office to evaluate systems to detect nuclear or radiological materials on the rails to ensure that these systems are established and a deployment strategy is developed to detect such materials arriving by rail.

Section 130 - requires the Secretary to screen in-bound rail shipments to the United States for terrorists or weapons of mass destruction

Section 134 - directs the Secretary to assess, and report the results to Congress on, the safety and security vulnerabilities of placing high voltage electric transmission lines along active railroad rights-of-way.

Section 136 - directs the Secretary of Transportation to establish a program to coordinate with state and local governments to minimize the need to transport toxic inhalation hazardous materials by rail.

On November 30th, Save Our Village posted an alert to New Hyde Park residents and neighboring communities about Brookhaven Lab and its plan to transport radioactive soil along the LIRR mainline corridor. Additionally, it has always been SOV's assertion that one of the major goals of the LIRR Mainline Corridor Improvement Project, coupled with the LI Truck-Rail Intermodal Facility Project, is to enable significantly more freight railway traffic to pass through the mainline corridor. This increase in freight traffic is a potential threat to the quality of life of all those citizens who reside in mainline communities such as Bellerose Village, Floral Park, New Hyde Park, Garden City, Carle Place, Mineola, Westbury and Hicksville.

MTA Capital Program Review Board

Background:

Every five years, the Metropolitan Transportation Authority (MTA) must submit a capital spending program for the next five years. This fiscal system was established in the early 1980's to insure that New York's subways and commuter railroads (which were nearly collapsed in the late 1970's from decades of deferred maintenance) received adequate capital investment. This process was successful; thus, New York's rail transit systems presently function with reasonable reliability.

The VOTE and the VETO

Under NYS Law, an MTA Capital Program must be unanimously approved by a four member board known as the Capital Program Review Board. Approval of a capital program is presumed unless, within 90 days, a member of this board vetoes it. The members of this board are appointed by the Governor of New York, NYS Senate Majority Leader, the NYS Speaker of the Assembly, and the Mayor of New York City.
As a member of the Capital Program Review Board (CPRB), each member is responsible for reviewing, monitoring, and approving the MTA's proposed multi-billion dollar five year spending program. Since all capital programs must be unanimously approved, each member's power to veto enables him/her to pass and/or reject any proposal(s) presented to the CPRB.
On matters related to commuter railroads, Ms. Astrid Glynn, Senator Dean Skelos, and Assemblyman Keith Wright are the members of the CPRB who must vote unanimously to pass commuter railroad-related transportation proposals. A veto by any one of these members can stop a proposed project as well as the allocation of monies to fund this project. Additionally, any individual on the CPRB can approve the project with stipulations added to an agreement. Mr. Doctoroff is the 4th member of the CPRB who votes on issues related only to NYC Transit proposals.
As a result of Senator Skelos' (9th Senate District, Nassau County) leadership on the MTA Capital Program Review Board, the MTA is presently advancing one of its most comprehensive rail systems expansion programs in over 50 years! In 1998, Senator Dean Skelos was appointed to the CPRB by Governor Pataki and since then, he has served as the NYS Senate's representative on this four-member board.

Federal Funding for Transportation Projects

Timeline:
After the MTA and the LIRR produce the Draft Environmental Impact Statement (DEIS), citizens can attend public hearings to voice their comments about the project. These public hearings usually take place approximately three months after the DEIS is issued. Thereafter, the MTA and the LIRR must address the concerns raised by citizens during the public comment period in their Environmental Impact Statement (EIS) to satisfy federal guidelines. Afterwards, the Federal Transit Administration (FTA) may allocate money approved by Congress through the Transportation, Housing and Urban Development Appropriations Bill.

Federal Procedures and Guidelines

Annually, the ENTIRE Congress votes on approximately 11 Appropriations bills. One of these bills is called "The Transportation, Housing and Urban Development Bill." If this bill is approved by Congress, the funds are allocated to the Department of Transportation which then allocates a portion of this funding to ALL the individual states. This funding is used for roads, highways, bridges, tunnels, airports and railroads.
After an Appropriations Bill is approved by Congress, no member of Congress can add amendments to the bill. All amendments or stipulations must be added to the bill before the vote.
The MTA/LIRR may choose not to use federal money to fund its projects. Instead, they may choose to fund an entire project with money allocated to them through the NYS Department of Transportation.

Recently, Brookhaven National Laboratory announced to elected representatives in Nassau, Suffolk, Queens and the Bronx that it will soon begin to ship 4,000 cubic feet of radioactive soil on railway cars to a disposal site out of New York State. The soil, which was excavated from a former waste disposal area at the Upton facility in Suffolk County, has been contaminated with cesium as a result of previous operations at the lab. It will be loaded onto several rail cars which will carry it to a containment facility in Utah. Freight trains on Long Island are operated by New York and Atlantic Railways on tracks owned by the Long Island Railroad.

It is important to note that the proposed Long Island Truck – Rail Inter Modal Facility (LITRIM) in Suffolk County and the LIRR Mainline Corridor Improvement Project are two of several railway expansion proposals in our region which can enable significantly more freight railway traffic to pass along the mainline corridor. Increased freight rail traffic can have a direct and negative impact on the quality of life of those citizens who reside in such “mainline” communities as Bellerose, Floral Park, New Hyde Park, Garden City Park, Garden City, Carle Place, Mineola, Westbury and Hicksville.

As SOV New Hyde Park continues to explore this development, we strongly encourage residents to share their concerns with those who have direct influence on matters which can potentially affect the health, safety and general welfare of our neighborhood – contact your local, state and federal representatives and let your voice be heard!

We do believe that there are other ways to achieve these goals. SOV strongly recommends that the MTA-LIRR and all federal, state and local elected representatives who have influence regarding this issue:

vigorously explore other viable alternative plans which will promote greater safety and the reduction of roadway congestion;
responsibly endorse the best plans that inflict the least collateral damage to family homes and properties;
respectfully negotiate with all citizens who are directly and indirectly impacted so that they do not suffer unfair economic hardship and can remain residents within their chosen community.

Once again, Save our Village supports the vision of at-grade crossing eliminations in New Hyde Park. However, we will settle for nothing but the best plans to achieve this goal...regardless of the cost.

Upon hearing this announcement, the officers of SOV took immediate note of Ms. Williams' comments and responded to countless calls about her message. Additionally, we are happy to report that Senator Craig Johnson, once again, remembered our plight and immediately advocated for citizens' direct communication with Mrs. Williams regarding the "pair of options" which she referred to in her announcement. Dear Ms. Williams:

I read with great interest an article in Newsday today regarding your plans for the Third Track. As you know from meetings I have had with you since you became LIRR President, I am vehemently opposed to the Third Track project until the MTA / LIRR presents a clear and honest plan that meets with the approval of local residents, civic leaders and government officials. One aspect of the article which stood out to me the most was your quote – “A pair of options for the Long Island Rail Road's plan to establish a third track along a 10-mile stretch of its Main Line will be unveiled at a series of public hearings this spring.” This is welcome news and I appreciate your willingness to allow the residents who could be most adversely affected by the plan to let their voices be heard.

To that end, I respectfully request that you hold a series of public meetings in close proximity to the following communities in my Senate district - Bellerose, Floral Park, New Hyde Park, Garden City Park, Carle Place, Mineola, Westbury and Hicksville. The residents of these communities will bear the brunt of any plans you put forward and therefore deserve as many chances as possible to speak their minds.

I also request that you give local civic groups an opportunity to host meetings for their members with representatives from the MTA / LIRR in attendance. There are a number of local groups in my district who have taken a keen interest in the Third Track project and one of their biggest complaints, which I share, has been the lack of direct communication from the MTA / LIRR to the community about the true nature of the project. On October 29^th, 2007 Save Our Village hosted an educational seminar entitled, “Citizens vs. the Threat of Eminent Domain” as it relates to the impact of current proposals set forth in the MTA-LIRR-NYSDOT’s “LIRR Mainline Corridor Improvement Project”. Historically, in cases that involve eminent domain, homeowners whose properties have been identified as “condemned” are at risk for serious economic hardship since the proposed compensation is often significantly less than if these residents sold their homes privately. Thus, our New Hyde Park neighbors, the "human costs" of these proposals, will be forced out of our community. It is also important to note that the resulting loss of tax base will burden the remaining taxpayers who reside in our community. Additionally, while our school district could be compensated if it lost its own property to such projects, it cannot be compensated for the loss of tax base that results from the condemnation and elimination of residential homes and businesses in the area. Thus, the remaining taxpayers, all the citizens who reside the "11040" area, will be forced to pick up the costs which result from condemnation in the form of higher school taxes and higher property taxes.

The first keynote speaker, Mr. A. Thomas Levin, Esq., who was honored with the "2006 Public Interest Attorney of the Year" Award by the Touro College’s Jacob D. Fuchsberg Law Center located in Huntington, is a member of the law firm of Meyer, Suozzi, English & Klein P.C., and Chair of the firm's Municipal Law, Land Use and Environmental Compliance practice. He concentrates his practice in the fields of local government law, land use regulation, and commercial litigation, representing both private and public sector clients. He serves or has served as special counsel to numerous villages, local governments and agencies. Mr. Levin is also the current President of the National Caucus of State Bar Associations and Past-President of the New York State Bar Association.

The second keynote speaker, Mr. Edward Gutleber, Esq. is an expert in the area of eminent domain law and he represents property owners in appropriation damage claims. Prior to joining the law firm of Meyer, Suozzi, English & Klein P.C., he served as Deputy Chief of the Municipal Services Bureau, Real Estate and Condemnation Unit, of the Suffolk County Attorney’s Office and as a principal litigation attorney in county condemnation and real property tax cases. Mr. Gutleber was a member of the NYS Bar Association House of Delegates from 1994-2002 and elected as a Fellow of the NY Bar Foundation in 1999, and the recipient of the Suffolk County Bar Association’s Award of Recognition in 1990 and 1995.

The evening was devoted to learning the theory and practical applications of eminent domain law. The harsh economic realities that will be imposed on our community as a result of the proposed condemnation and elimination of homes and small businesses in New Hyde Park quickly became evident on the faces of those present in the audience. While this project will impact other communities along the mainline, New Hyde Park faces significant and serious challenges in the near future. It is important to note that both Mr. Levin and Mr. Gutleber agree, “The courts in the end do not second guess the wisdom or the merits of the decision…that is a political decision...Projects more often get defeated politically than in the courts." Save Our Village extends our appreciation to both these experts for their time, their consideration, and their dedication in helping our neighbors who will potentially face serious hardship in the near future as well as helping our community, in general, which faces an uncertain economic future as a result of these current proposals.

Our special guest, Senator Craig Johnson of the 7^th Senate District addressed the audience regarding the local and regional impact of the LIRR Project and his views on the issues. It is important to note that Senator Johnson reiterated that he is against the Third Track Project “and will continue to be against the Third Track Project until the MTA presents a clear plan to the community that is approved – and this is most critical – that it is approved by you the residents, by your local civic organizations and by the local officials."

Save Our Village respectfully asserts that the “human costs” of the MTA-LIRR-NYSDOT's current plans, coupled with the serious negative economic implications for the remaining taxpayers in our community, require a commitment to careful deliberation by our elected representatives and direct consultation with the voters and taxpayers who live along the mainline. SOV New Hyde Park encourages those who propose and/or endorse railroad modification: (1) to learn more about the consequent economic and environmental effects it imposes on the mainline corridor communities, (2) to advocate for the deliberate and vigorous exploration of viable alternative proposals that reduce roadway congestion and promote safety, and (3) to responsibly endorse the best plan that imposes the least collateral damage to family homes and properties, school districts, small businesses, and the environment in our immediate area – regardless of its cost.

Long Island Freight Derailment Prompts Serious Concerns

On October 23, 2007, another railway accident occurred involving freight cars owned by New York and Atlantic Railway. Two cars on a freight train hauling stone derailed in Holtsville (Suffolk County), forcing the temporary suspension of service on the Long Island Rail Road between Ronkonkoma and Yaphank Freight trains on Long Island are operated by New York and Atlantic Railways on tracks owned by the LIRR.
The Long Island Truck – Rail Inter Modal Facility (LITRIM Facility Project) at the former Pilgrim State Hospital site in Kings Park is under review by the NYS Department of Transportation. This project coupled with the LIRR Mainline Corridor Improvement Project are two of several rail expansion proposals in our region which may result in significantly more freight railway traffic passing through the mainline corridor. This can potentially have a direct and negative impact on the quality of life in Bellerose, Floral Park, New Hyde Park, Garden City Park, Garden City, Carle Place, Mineola, Hicksville, and the surrounding communities.

Increasing the capacity of freight rail traffic justifies our immediate concern about the increased potential for freight derailments and other accidents. This time, the derailed freight cars were hauling stone. However, are our village, town and county government agencies prepared to address the immediate consequences of a potentially catastrophic accident involving other kinds of freight passing through our neighborhood? Although SOV New Hyde Park continues to explore this important development, we encourage all residents who live along the mainline corridor to make their concerns known to those who have direct influence on these matters.

Dear Editor,

On Monday, August 13, representatives of the Save Our Village Association, Inc. attended the NHP – GCP Board of Education meeting. Although the focus of this meeting was related to a rather controversial issue, it was uplifting to observe concerned citizens as they exercised their right to free public comment regarding a matter which was perceived to have jeopardized our community’s values and ethics. SOV New Hyde Park Association wishes to positively recognize the citizens who respectfully expressed their concerns about this issue in order to protect the values and traditions that New Hyde Park-Garden City Park families have held so dearly over the years.

It is this uplifting experience which has inspired the SOV New Hyde Park Association to reach out to all those concerned citizens who attended this Aug. 13^th meeting. As you may know, SOV New Hyde Park Association, Inc. is a new civic association which was organized in response to another critical issue that can potentially endanger the suburban lifestyle and quality of life we value so dearly in our community. This issue relates to the “LIRR Mainline Corridor Improvement Project” and the detrimental effect it will have on the lives of our neighbors and friends as well as the economic stability of all those who reside in the “11040” area.

As a result of the LIRR proposals, senior citizens will be burdened with packing up their lifetime homes and possessions, negotiating the purchase of a new home on a fixed income, and relocating to unfamiliar areas which are void of the support network that they have come to rely upon for many years. Families who are close to paying off their home mortgages and children’s college educations will now have to put their American dream on hold while they dig deeply into their savings to purchase another home. Prominent members of our community, some of whom have made significant contributions to our civic associations, religious congregations, and volunteer organizations, will no longer enjoy the community network which they helped to establish in our community. New and young families, who came to New Hyde Park to provide their children with a quality education and safe environment, will have to uproot their families once again and face uncertain futures in unstable economic times. Hardworking homeowners and taxpayers, who have devoted their time, money, and labor to beautifying and modernizing their homes, will likely lose a good portion of their largest personal investment. Due to the nature of eminent domain laws in our country, the properties of these homeowners and taxpayers will, no doubt, be rendered valueless as the negotiation process continues to unfold. These “human costs”, coupled with the serious environmental and economic effects imposed by this project, will have long-lasting negative effects on our community.

Regarding our schools, SOV New Hyde Park strongly believes that the scope and severity of LIRR Project will negatively influence the daily operation of regular school business in New Hyde Park. Thus, one can reasonably expect that our children’s educational experiences will be compromised in the process. It is evident that the parents of the NHP-GCP School District value high educational standards and advocate for a myriad of educational opportunities and experiences for their children. Sadly, SOV New Hyde Park believes that the LIRR Project promotes a serious “human cost” - namely, an anticipated negative impact to the educational process of our children. Recently, representatives of SOV New Hyde Park shared a documented analysis of this negative impact with members of the NHP-GCP Board of Education. We appreciate the Board’s anticipated active role in disseminating this information and motivating parents to learn about this issue’s critical impact to their children, their property values, and their overall quality of life in our neighborhood.

This is a critical time for the residents of the “11040 community.” The MTA/LIRR and NYS Dept. of Transportation have made serious proposals that can inflict permanent changes and challenges to our neighborhood and our suburban quality of life. The potential urbanization that may result from these proposals threatens our quality of life, our economic stability, and the quality of our children’s education. The condemnation and elimination of residential homes and small businesses via eminent domain will force our neighbors and friends out of New Hyde Park because they will not be fairly compensated for the loss of their homes; other neighbors will lose parts of their properties. Remaining taxpayers within the “11040” area will be burdened with increased property and school taxes to make up for the loss of tax revenue.

Clearly, the parents and friends of the NHP-GCP School District demonstrated that there is power in collective voice! SOV New Hyde Park cordially invites their support on behalf of our neighbors, our friends, our families, and our children. It is important to note that SOV New Hyde Park is planning an upcoming educational event on October 29^th for which we respectfully request the attendance of all residents who seek to preserve our suburban lifestyle. "There has been a lot of chatter lately regarding the MTA's proposed Third Track expansion. I feel it is important to reiterate my opposition to this project. I am against Third Track and will continue to oppose Third Track until the MTA presents a clear plan to the community that is approved by residents, civic organizations, and local officials. As it stands, I have grave concerns about the current proposal and the disastrous effect it will have on the quality of life in many of the communities it will touch. This has always been my stance, contrary to rumors and innuendo that has been manufactured by those who put politics ahead of the needs of our communities. Since taking office, I have worked closely with the New Hyde Park Save Our Village Association to make sure that the voices of opposition to this project are not ignored. I agree with their stance that this is a regional issue, not just a Nassau issue. To that end, I prevailed in securing an extra 61 days for public comment on a Kings Park plan that would make it easier to transport freight from tractor trailers to our rail system. This project, coupled with the Third Track, could severely and negatively alter the quality of life for residents in Bellerose, Floral Park, New Hyde Park, Garden City Park, Garden City, Carle Place, Mineola, Hicksville and the surrounding communities. Despite this impact, many residents in our communities were not alerted to this project's significance. With this additional time for public comments, which will last until Sept. 24, we have been able to get the word out and provide the opportunity for every voice to be heard. I have also met with MTA officials to express my own opposition, as well as the opposition of many of our residents. This is an issue that trumps political affiliation and all the other philosophical differences that keep us apart. If we all stand together, I believe we will have the strength to maintain the quality of life that we treasure and want to preserve for our children and our children's children."

Senator Craig M. Johnson announces that the public comment period for a freight-rail project that has implications on the MTA's controversial Third Track Expansion has been extended. Residents will now have until Sept. 24 to issue their written comments on the Long Island Truck – Rail Inter Modal Facility at the former Pilgrim State Hospital site in Kings Park. This project, which is under review by the state Department of Transportation, will make it easier to transfer freight from tractor trailers to rail beds.This facility is one of several integrated rail expansion proposals for the region, which also includes the Third Track. If both projects are approved, it could result in more rail traffic in the mainline corridor and have a direct impact the quality of life in Bellerose, Floral Park, New Hyde Park, Garden City Park, Garden City, Carle Place, Mineola, Hicksville, and the surrounding communities, Senator Johnson said. “What happens at Kings Park can very well affect what happens in our own back yard,” Senator Johnson said. “It is of the utmost importance that everyone have the opportunity to have their voices heard.” The cutoff for public input was initially supposed to be July 24. Fearing that many Nassau County residents were not informed of the potential ramifications of this project, members of the New Hyde Park Save Our Village Association reached out to Senator Johnson and asked for his assistance in extending the time frame. Senator Johnson contacted the state DOT and was able to secure a 61-day extension. “I thank DOT officials for working with us and providing this extra time to make sure that our residents are provided the information and the opportunity to become involved in the process,” Johnson said. Robert Femminella (SOV President) and Diane Bentivegna (SOV Vice President) had the pleasure of meeting with NY State Senator Craig Johnson and his Chief of Staff, Rafe Lieber on July 18, 2007. During their lengthy and productive discussion, Senator Johnson was presented with an introduction to SOV’s mission as well as a detailed agenda of issues which included a request to obtain an extension of time for the public to comment on the NYSDOT's LITRIM Facility Project so that mainline communities in Western Nassau would have an opportunity to give voice to their concerns about its impact.

Thanks to Senator Johnson’s immediate intervention, the deadline for public comment has now been extended to September 24, 2007. During this critical period in New Hyde Park’s history, SOV New Hyde Park embraces Senator Johnson’s positive support and the work he continues to accomplish on behalf of all the people who reside along the LIRR’s mainline corridor in the 7th District, including those who live in New Hyde Park. As SOV New Hyde Park grows in number, it has learned that establishing direct and collaborative relationships with governmental agencies has been helpful in enhancing the public’s confidence and trust in the services they provide to their constituents. For those who speculate about the real motivation that drives railroad expansion projects along the mainline corridor, we urgently recommend that you view the link below to the NYSDOT’s website regarding the proposed Long Island Rail-Truck InterModal (LITRIM) facility project which was launched after an extensive study. This project seeks to enhance the use of rail to deliver goods throughout Long Island. As a matter of fact, it seems 4000 tons of freight will be transported by the already existing LIRR mainline - an estimated amount which does not even include the use of a third track! Its funding was secured through the NYSDOT and other agencies. The proposed site of the former Pilgrim State Hospital was found to be the best possible location based on its access to the LIRR, accessibility to the Long Island Expressway, and its central location near the core of Long Island’s main developed areas.

In light of the recent freight train derailment on July 6th in Queens (please refer to the details in the post below), this significant increase in freight traffic along the LIRR 's mainline will potentially result in increased risk to the communities along the railway. On July 6, 2007 a serious railway accident occurred involving freight cars owned by the New York and Atlantic Railway. Police and other officials had to evacuate several blocks surrounding the accident site where a train carrying 33,000 gallons of propane gas derailed in Queens. Thankfully, officials said that no hazardous material leaked from the train and the evacuation was a precautionary measure. The accident occurred near Otto Road in Glendale on tracks owned by the freight company - about half a mile from the Maspeth site where another train derailed in January of 2007.

It is important to note that freight trains on Long Island are operated by New York & Atlantic Railway on tracks owned by the LIRR. The proposal of a 3rd track along the LIRR's mainline corridor increases the capacity for greater freight traffic to pass through the suburban neighborhoods that lie within the corridor - like New Hyde Park. SOV New Hyde Park remains opposed to LIRR's Third Track Project due to the inherent negative consequences it could potentially impose on our community. Increasing the capacity of freight traffic along the railroad justifies our immediate concern about the increased potential for freight derailments and other accidents.

Are our village, town, and county government agencies prepared to address the immediate consequences of a potentially catastrophic event in our neighborhood - within the immediate proximity of our homes, schools, houses of worship, and businesses? Although SOV New Hyde Park continues to explore this important issue, we encourage all residents who live along the mainline corridor to make their concerns known to those who have influence on issues related to the health and safety of our communities. News Alert: New Plan?

At a recent meeting with representatives of the LIRR, an alternative plan for the crossing elimination at Covert Avenue in New Hyde Park was presented to the officers of SOV and others. According to this alternative, a series of quadrant gates (a four gated system) would be installed at the Covert Avenue crossing and a potential “quiet zone” would be imposed at this site.

Although the plan claims to reduce the number of residential and small business condemnations along Covert Avenue, it is important to note that it will actually INCREASE gate down time at this crossing and therefore promote even GREATER roadway congestion! Not only does SOV anticipate that the NYS Dept. of Transportation will have great difficulty endorsing such a proposal due to its inherent weaknesses, we also assert that such a plan may, in fact, be detrimental to the health and safety of our community and to those who travel along this roadway.

Additionally, this alternative allows for the installation of the third track through New Hyde Park in a manner that is even less costly than the original proposal. Not only is SOV highly speculative about the need for the third track, but we also remain unconvinced about the benefit it will afford the residents of our community.

Thus, we respectfully encourage the MTA, LIRR, and the NYS Dept. of Transportation to go back to the drawing board and create a plan that considers more than just the budgetary impact it will have on their own purses! The residents of New Hyde Park will settle for nothing less than the best plan – one which reduces roadway congestion, promotes greater safety, preserves our suburban lifestyle and eliminates the need to condemn residential and small business properties in our community.
